1.2 These website terms are intended to establish the terms and conditions governing access to the information and content available on the website www.breakfreeadventours.com, as well as the booking and payment processes for end customers.

1.3 Break Free Adventours reserves the right to insert, modify, and remove any information in these terms and conditions without prior notice and at its sole discretion. The user is responsible for reviewing the content of these terms each time they access or book trips through the website www.breakfreeadventours.com. The use of the website www.breakfreeadventours.com, following any changes made by Break Free Adventours, will be considered as tacit acceptance of those changes.

2. Website Access

2.1 Break Free Adventours and the website users agree that access to the site, its viewing, use, or bookings made through it, are governed by these terms and conditions.

2.2 The use of this site implies and assumes that users fully and unreservedly accept all the conditions of the website as published and in effect at the exact moment they access the portal, particularly those regarding limitation of liability, as well as those of any travel or tourism service providers. Therefore, users must carefully read these terms before using the portal and expressly declare that they have read and understood them, as they may have been modified since their last visit.

2.3 Access to and use of this portal is restricted to individuals aged 18 or older and who are legally capable of doing so.

2.4 Break Free Adventours reserves the right to deny access to the website without prior notice, and access is only permitted to individuals aged 18 or older who are legally capable of doing so.

2.5 Without prejudice to the above, both parties agree to comply with all applicable laws and regulations concerning the website and the bookings made through it.

3. Alterations to the web site

3.1 Break Free Adventours may implement improvements or changes to the information, elements, data, services, and other content on this website, or cancel it at any time without prior notice.

3.2 Break Free Adventours may also modify these website terms at any time, and such modifications will be valid as of the date they are posted on the website.

3.3 Consequently, access to and continued use of the website implies that users have approved the new terms and conditions.

3.4 Break Free Adventours may suspend access to the system covered by this program, due to maintenance work, network security reasons, or force majeure ("acts of God"), without prior notice.

4. Responsability

4.1 Without prejudice to the general terms and conditions of sale for the services/products available on this website, and to the extent legally permitted, Break Free Adventours provides no warranties of any kind, either express or implied, including but not limited to warranties of ownership, non-infringement, or implied warranties of merchantability or fitness for a particular purpose, regarding the availability, accuracy, reliability, or content of these pages.

4.2 To the maximum extent permitted by law, Break Free Adventours shall not be held liable under any circumstances for any damages, including lost profits and consequential damages, that are directly or indirectly related to the use or inability to use the content, materials, features, and information available through the website. www.breakfreeadventours.com, mesmo que a Break Free Adventours tenha sido informada da possibilidade de ocorrência desses danos.

4.5 The website www.breakfreeadventours.com may contain information, links, or materials from other websites not owned by Break Free Adventours, for which the authors of those websites are solely responsible. Break Free Adventours assumes no responsibility for the information, links, or materials included on those sites.

4.6 The website www.breakfreeadventours.com may contain "links" (electronic links) to third-party websites. These links are provided solely for informational purposes, and Break Free Adventours assumes no responsibility for the accuracy, completeness, or legality of the content on those websites, nor for any information, opinions, products, or services offered therein. Break Free Adventours hereby declares that it has no control over third-party websites with regard to confidentiality risks, security, or other related concerns.

4.7 The user is responsible, in all cases, for the accuracy of the information provided. Break Free Adventours reserves the right to exclude from its registered services any user who has provided false information, without prejudice to any further actions or procedures that may be pursued through judicial channels.

4.8 By sending materials to any of Break Free Adventours' servers via email or through its website pages, the user agrees to the following: (i) the materials must not contain any elements that are illegal or unsuitable for publication; (ii) the user must scan for and remove any viruses or other destructive elements before submitting any material; (iii) the user either owns the material being sent or has unlimited rights to provide it; (iv) Break Free Adventours may publish such materials without charge and/or incorporate them, or any concepts described within them, into its products.

II. CONTRACTED SERVICES

1. General

1.1 The Terms and Conditions detailed here constitute the entire agreement between the user and Break Free Adventours (King’s Travellers Lda.), located at Travessa do Picoto nº19 4800-157 Guimaraes, registered with the Porto Commercial Registry Office under company identification number 514606711 and RNAVT 7494. This agreement may only be amended in writing by an authorized representative of Break Free Adventours.

1.2 Break Free Adventours is an agency that organizes trips for those interested, and therefore is not a transportation carrier, hotel chain, or owner of its own aircraft or hotels. All bookings with carriers, hotels, and other service providers are subject to the terms and conditions and liability limitations imposed by these carriers, hotel chains, and other service providers, with whom Break Free Adventours has partnerships or may engage when necessary. Please note that some of these conditions limit or exclude liability in cases of death, bodily injury, delays, or loss or damage to baggage. Therefore, we accept no responsibility for any loss resulting from such events or from any act or omission by third parties..

1.3 The Terms and Conditions mentioned here for registration are a supplement to the travel plan in which you enroll.

1.4 By reaching an agreement with Break Free Adventours, you acknowledge and accept all the Terms and Conditions set forth.

2. Insurance and Travel and Tourism Guarantee Fund

Break Free Adventours’ liability is covered by a civil liability insurance policy with Fidelidade Seguros and by the Travel and Tourism Guarantee Fund of Turismo de Portugal, in accordance with current legislation.

3. The Reservation

3.1 To make a reservation, the customer must access the contact form available on the website, complete it fully and as detailed as possible, and send it back to Break Free Adventours, which will then provide appropriate follow-up for the request. We recommend contacting us as early as possible to ensure we can secure the best possible rates for transportation, accommodations, and related activities.

3.2 After receiving the contact form, Break Free Adventours will get in touch with the customer to provide more detailed information regarding the selected trip.

3.3 If the customer wishes to customize their trip, after receiving the contact form, Break Free Adventours will respond with additional questions aimed at clarifying in more detail the customer's goals and budget for this experience/travel.

3.4 For customized trips, Break Free Adventours will proceed with the travel request by developing an initial budgeted itinerary for validation, which can then be modified until the customer's desired outcome is achieved. The customer may request up to two changes to the original itinerary at no additional cost. Beyond this limit, each subsequent change will be added to the final budget amount, with a fee of 20 Euros per modification.

3.5 Whether the trip is customized or not, and once the customer confirms interest in proceeding with the booking, they must make a bank transfer of a deposit of approximately 50% of the trip's total value (if booked at least 60 days in advance), within a maximum of 72 hours, to Break Free Adventours' IBAN, and send the corresponding payment confirmation to Break Free Adventours' email address info@breakfreeadventours.com, including their personal details and information about the trip they are booking. If the reservation is made less than 60 days in advance, the full amount for the trip must be paid upfront. Only from that point onward (full payment of the trip cost) does the process of making the reservations related to the submitted request begin.

3.6 If the customer cancels the reservation, and the cancellation does not result from non-payment or any other breach of these terms and conditions, the deposit will be retained by us.

3.7 If the full payment is not received within the time frame specified in these terms and conditions, Break Free Adventours reserves the right to apply late payment fees, or to treat your reservation as canceled, retaining the deposit as a cancellation fee.

3.8 After receiving the full payment for the trip you've booked — subject to availability — Break Free Adventours will confirm your spot on the selected trip. An agreement is formed between you and Break Free Adventours only after the reservation has been confirmed by us and communicated to you in writing (via email or other means). By confirming the reservation, you authorize Break Free Adventours to contact, on your behalf and in your name, the entities — providers of goods and services — responsible for carrying out the trip. The provision of the trip is handled by Break Free Adventours or its partners, including travel agencies, accommodations, transportation providers, or others, as agreed upon.

3.9 In the case of a customized trip, all information provided in the proposal sent by email is accurate based on our current knowledge. However, we cannot guarantee that every listed item will remain available, especially if we do not have direct control over it (such as third-party services, for example).

3.10 Break Free Adventours is committed to providing you with the best possible travel experience, based on what we understand to be the highest quality standards for the selected itinerary, accommodations, transportation, and tours/guides booked locally, as requested in your registration form.

4. Responsability

4.1 Under no circumstances can Break Free Adventours be held responsible for weather conditions, and no experience may be canceled or altered by you at any time based on weather conditions.

4.2 Under no circumstances can Break Free Adventours be held responsible for any damage/loss of property, or injury/death of individuals, that may be attributed to you for failing to follow safety signs and advice.

4.3 Break Free Adventours advises you to carefully read the program of the experience being offered. We are only responsible for the bookings that were specifically requested in the contact form.

4.4 No refund will be issued for meals, accommodation, excursions, etc., that you chose not to use or when the places to visit are closed.

4.5 No amount will be refunded if, due to circumstances beyond the control of Break Free Adventours — such as delays, cancellations, or disruptions related in any way to legislation, regulations, acts or omissions, claims, governmental orders or interventions, or actions by government authorities; or Acts of God, strikes, fires, floods, war, rebellion, terrorism, revolutions, illness, quarantine, epidemics, theft, or any other cause beyond our control — such events occur and prevent the trip from taking place.

4.6 You are responsible for any costs incurred as a result of damages or additional cleaning fees related to your booking, including but not limited to transportation, accommodations, visits, and activities. You are advised to immediately report any pre-existing damage you notice to the staff of the respective location and/or your accompanying guide as soon as it is detected.

4.7 When the traveler occupies a seat in a vehicle equipped with a seatbelt, service providers or operators, agents, or organizations involved cannot be held liable for any illness, injury, or death, nor for any loss, damage, or claims resulting from any accident or incident, if the seatbelt was not being used at the time of the accident.

4.8 Participants are responsible for carrying their own luggage to and from transportation and to their rooms. There may be situations where participants must carry their luggage over long distances or through areas with obstacles, and no assistance will be provided unless the cost of such assistance is covered by the participant themselves.

5. Price

5.1 Prices are always set in Euros.

5.2 If, after your reservation has been confirmed, you wish to make any changes, you may do so subject to availability, provided the new date is listed on our website and/or social media, and the change must be requested at least 60 days before the start of the tour. Otherwise, the cancellation policy for customer-initiated cancellations will apply. A fee of 25 Euros per person per modification will be charged, plus any additional fees imposed by accommodations, tourism agencies, or transportation providers.

5.3 Changes to additional services (transfers, pre- and post-tour accommodation, upgrades, additional activities) will incur a fee of 20€ per person per service, plus any additional fees that may be charged by accommodations, transportation providers, or tourism agencies.

5.4 The prices listed in the program are based on the costs of services and exchange rates in effect at the time of printing, and are therefore subject to change (either increasing or decreasing) due to fluctuations in transportation or fuel costs and other energy sources, taxes, or fees imposed on included travel services by third parties not directly involved in the execution of the organized trip — including accommodation taxes, as well as exchange rate variations — up to 20 days before the travel date.

5.5 If the price increase exceeds 8% of the total cost of the organized trip, the provisions outlined in point 9 will apply. In the case of a price reduction, the travel and tourism agency reserves the right to deduct from the refund due to the traveler the corresponding administrative expenses, which will be justified upon the traveler’s request.

5.6 Not included in the price, unless otherwise stated in the program: flights to and from your destination, airport fees, passport fees and visas, laundry service, personal transportation, local guides not mentioned in the program, phone calls, drinks, meals not detailed in the itinerary, tips, personal items, baggage overweight charges, and optional excursions.

6. Payment Methods, Registrations, and Refunds

6.1 At the time of the preliminary reservation (if made more than 60 days before the start date of the tour), Break Free Adventours requires a bank transfer of 50% of the total trip cost, issuing a corresponding receipt that specifies, in addition to the amount paid in advance by the traveler, the organized trip requested. The remaining balance must be paid no later than 60 days before the start of the tour. Reservations are subject to confirmation of all services by the respective suppliers.

6.2 Failure to pay the full price of the trip under the conditions mentioned will result in the cancellation of the trip, and the conditions outlined in point 7 will apply.

6.3 If, prior to the start of the trip, Break Free Adventours finds itself unable to provide one of the services requested by the traveler (including in cases of price increases exceeding 8% as previously stated), this will be communicated to the traveler by Break Free Adventours. In such cases, the traveler may choose to cancel the reservation and will be refunded any amounts already paid in advance.

6.4 All refunds will be processed exclusively through Break Free Adventours and no reimbursement will be made for services voluntarily not used by the traveler.

6.5 Payments must always be made in Euros.

7. Traveler's Cancellation

7.1 For trips organized by Break Free Adventours, the traveler may cancel the requested or contracted services at any time and will be entitled to a refund under the following conditions:
a) If canceled 60 days before the start of the tour , Break Free Adventours will retain 10% of the deposit as a service fee. Any amount paid beyond the deposit will be refundable (after deducting any non-recoverable costs).
b) If canceled between 31 and 59 days before the start of the tour , Break Free Adventours will retain 100% of the deposit , and the remaining balance will be refunded (after deducting any non-recoverable costs).
c) If canceled 30 days or fewer before the start of the tour , Break Free Adventours will retain the full amount already paid .
d) Once the trip has been confirmed via email, message, social media, or any other means, no refund will be issued , regardless of the cancellation date.

7.2 Cancellation of additional services such as transfers, pre- and post-tour accommodation, upgrades, and extra activities, booked directly with BF:
a) The Terms and Conditions of third parties, subcontractors, or partners apply.

7.3 If applicable, the traveler will be refunded the difference between the amount paid and the amounts referred to above. In this case, the refund will be made within a maximum of 14 days after termination of the travel contract, deducting the applicable cancellation fee.

7.4 Once the trip has begun, no refund will be due for services not used by the traveler due to force majeure or reasons attributable to the traveler, unless the respective service providers issue a refund. If services included in the travel program are not provided due to reasons attributable to Break Free Adventours, and no equivalent alternative services can be arranged, the traveler is entitled to a refund of the difference between the price of the planned services and those actually delivered.

7.5 In exceptional circumstances, any additional costs resulting from changes will be covered by the customer. Break Free Adventours is not responsible for any incidental costs that may arise from itinerary changes, such as visas, vaccinations, flights, accommodations, or other related expenses.

7.6 For all purposes, an event of force majeure is defined as any natural occurrence or human action which, although foreseeable or even preventable, could not be avoided either in itself or in its consequences. This includes, but is not limited to: war, hostile acts or guerrilla warfare, terrorist attacks, uprisings, riots, or military or civil insurrections; quarantine restrictions, epidemics; strikes, labor disputes of any kind; restrictions or seizures of goods or persons imposed by any public or governmental authority; adverse weather conditions (including phenomena such as dry fog); natural disasters; public enemies; lack of necessary governmental authorizations; or any other cause of a similar or different nature that is beyond the control of Break Free Adventours.

7.7 The traveler also has the right to terminate the travel contract before the trip begins without paying any cancellation fee, if unavoidable and exceptional circumstances occur at the destination or in its immediate vicinity that significantly affect the trip's execution or the transportation of passengers to the destination. In this case, termination of the travel contract entitles the traveler only to a full refund of all payments made.

8. Termination of Contractual Position

8.1 The traveler may transfer their position by being replaced by another person who meets all the required conditions for the organized trip, provided that Break Free Adventours is informed in writing at least seven consecutive days before the scheduled departure date.

8.2 The assignor and the assignee are jointly responsible for paying any outstanding balance, fees, charges, or additional costs resulting from the transfer, which will be properly communicated and documented by the travel and tourism agency.

9. Changes Made by Break Free Adventours

9.1 Break Free Adventours commits to providing its clients with all the services included in the travel program/offer (promotion) that originated the organized travel contract. However, if, prior to the start of the trip: (i) Break Free Adventours is forced to make significant changes to any of the main features of the travel services, (ii) it fails to meet any special requirements requested by the traveler, or (iii) it proposes a price increase of more than 8% to the total cost of the organized trip, the traveler may:
a) Unless otherwise agreed between the parties, choose one of the following options: To terminate the contract without penalty, To accept modifications to the contract specifying the changes made and their impact on the price, or To accept an alternative organized trip proposed by Break Free Adventours.
b) If the traveler chooses to terminate the contract as described above, or if Break Free Adventours cancels the organized trip before the agreed departure date for reasons not attributable to the traveler, the traveler is entitled — from the moment the contract is terminated — to either: A full refund of all amounts already paid, or An alternative organized trip of equal or higher quality, if Break Free Adventours is able to offer one. If the alternative trip offered is of lower quality, Break Free Adventours must reimburse the traveler the difference in price based on the amount already paid under the original contract.

9.2 The traveler must communicate their decision to Break Free Adventours within seven days of being notified of the changes referred to in points (i) to (iii). If the traveler does not notify their decision within this timeframe, it will be understood that they have tacitly accepted the proposed conditions.

10. Contract Termination by Break Free Adventours

10.1 When a trip is dependent on a minimum number of participants, Break Free Adventours reserves the right to cancel the organized trip if the required minimum number is not met. In such cases, the traveler will be notified in writing of the cancellation within the following deadlines:
a) 20 days before the start of the trip, for trips lasting more than six days;
b) 7 days before the start of the trip, for trips lasting between two and six days;
c) 48 hours before the start of the trip, for trips lasting less than two days.

10.2 If the Tour is canceled by Break Free Adventours for reasons other than Force Majeure, you may choose one of the following options:
a) Replacement of the Tour with another of equal or higher value;
b) Replacement of the Tour with one of lower value, if no tours of equal or higher value are available, receiving a refund of the price difference;
c) Full refund of the amount paid for the Tour, excluding any non-refundable costs.

10.3 Break Free Adventours reserves the right to issue a full refund of the Tour value instead of offering the options listed above, at its sole discretion.

10.4 Before the start of the organized trip, the travel and tourism agency may also terminate the contract if it is prevented from fulfilling the trip due to unavoidable and exceptional circumstances. Such circumstances are understood to be those beyond the control of the party invoking them, abnormal and unforeseeable, whose consequences could not have been avoided even with the exercise of due diligence.

10.5 The termination of the travel contract by the agency under the terms described above only entitles the traveler to a full refund of all payments made, to be processed within a maximum of 14 days after the contract termination. The agency has no obligation to provide additional compensation or indemnification.

10.6 Break Free Adventours is not responsible for any expenses arising from the Tour booking, including but not limited to visas, vaccinations, non-refundable transportation tickets, parking fees, or any other expenses, loss of income, or loss of vacation days.

11. Extra Services

11.1 Any activities, transportation, meals, products, or services not explicitly included in the itinerary or in the price of the Tour are considered extra services and are not part of the original Tour package.

11.2 The customer agrees that any assistance provided by Break Free Adventours' representative(s) in the organization, selection, or booking of any Optional Services is given solely at the customer’s request. Break Free Adventours offers no guarantees and expressly disclaims any responsibility arising from participation in Extra Services or from any information provided by any Break Free Adventours representative regarding such extra services.

11.3 The customer releases Break Free Adventours from all claims and causes of action arising from any damages, loss of enjoyment, inconvenience, or injuries related to or resulting from the participation in or booking of extra services.

11.4 The customer acknowledges and agrees that any liability for losses, damages, death, personal injury, illness, emotional distress, mental suffering, psychological injury, or property damage associated with extra services is the sole responsibility of the partner or provider offering that service or activity.

12. Complaints

12.1 Any discrepancy in the performance of a travel service included in the organized travel contract must be communicated to Break Free Adventours in writing or through another appropriate means as soon as the discrepancy occurs, without unjustified delay.

12.2 The right to file complaints for the purpose of price reduction or compensation due to non-conformity of travel services included in the organized trip expires within a period of 2 years .

13. Information to Be Provided to the Traveler

13.1 We inform the traveler that at the time of signing the contract, Break Free Adventours will provide information regarding the specific documentation required for the chosen trip, as well as details about potential risks associated with the destination and the contracted travel, in accordance with the General Travelers' Protection Law. For this purpose, however, we recommend that the traveler contact the Ministry of Foreign Affairs, whose information desk provides specific recommendations based on destination via the Internet (http://www.minnestrangeiros.pt/mne/) or through any other available means.

14. Travel Insurance

14.1 Travel insurance is mandatory for all our customers and must be presented at the time of booking. The travel insurance must include coverage for personal accidents, death, medical expenses, and emergency repatriation, with a minimum coverage of €200,000 for each of these categories.

14.2 Break Free Adventours also recommends that the travel insurance coverage include protection against trip cancellations, restrictions, civil liability, and loss of luggage or personal belongings. The customer must provide the insurance policy details and a 24-hour emergency contact number from the insurance company on the first day of the Tour. Participation in the Tour will not be allowed without submission of these details.

14.3 If the travel insurance is linked to the customer’s credit card, the customer must ensure they have all the insurance company details, including the policy number and 24-hour emergency contact number — not just the bank name and banking details.

14.4 The customer acknowledges that travel insurance is not included in the Tour price and is required to purchase this insurance at an additional cost

15. Photos & Marketing

15.1 The customer acknowledges that while participating in any Tour, images, photos, or videos may be taken by other participants, by Break Free Adventours, its representatives, or partners, and these may include or feature the customer. The customer consents to such recordings and grants Break Free Adventours, its affiliates, subcontractors, and partners a perpetual, royalty-free, worldwide, and irrevocable license to reproduce and use such content for any purpose (including marketing, promotions, and the creation of promotional materials with or through partners), in any media now known or developed in the future, without any further obligation or compensation to the customer.

16. Changes to Terms and Conditions

16.1 Break Free Adventours reserves the right to update or modify these terms and conditions at any time, and will publish the changes on its website.

16.2 Any changes will take effect 10 days after they are posted on the Break Free Adventours website.

16.3 An updated copy of the terms and conditions can be viewed at any time on the aforementioned website and will be sent to the customer upon written request to Break Free Adventours.

16.4 The customer is deemed to have accepted any changes to these terms and conditions if they do not submit a written complaint within 10 days of the updated terms being published on the Break Free Adventours website.

16.5 Break Free Adventours recommends that the customer review the terms and conditions before traveling to become familiar with the most up-to-date version available.
